Well… we didn’t exactly get the “bad” news that was our worst case scenario, but Judge Whyte did delay the start of the trial by a week so he could be briefed on all of the defendants arguments regarding the effect of the Delaware Ruling.
The reports from the courtroom that were reported on the IV RMBS Message Board seemed to indicate that he was leaning toward completing all of the trials before him and let them all be appealed at once to the CAFC. We believe the real question is whether or not Micron will be part of upcoming trials or not.
The HJW did ask about why not proceed with those patents in question that were not part of the ruling but this is definitely a toss up.
For now, we’ll hold on to our ST Put protection to see if we drift lower from here.
